CE Marking Liability





Product liability disputes can involve multiple claimants, substantial documentation and often complex technical and scientific issues.
Our product liability team has broad expertise across a wide range of industry sectors.  We advise manufacturing clients and their insurers on how to minimise claims occurring, as well as defending claims for them.
Through a deep understanding of our clients' industries, we can give focused, practical advice.  We have particular strengths in litigation, arbitration and mediation and draw from a wealth of resources and experience to resolve any disputes arising.
We are highly experienced in advising on regulatory compliance and frequently assist companies contemplating a product recall. Our team also works to help companies prevent product liability exposure from undermining the competitiveness and value of their brands.
This includes advising on:
  • conformity assessment procedures and CE marking relating to the "New Approach" directives;
  • labelling;
  • formulation of product safety manuals and warning notices;
  • matters arising out of the General Product Safety Directive; and 
  • product recalls.
As one of the world's largest specialist insurance practices, we regularly advise on product liability insurance issues, including property damage, 'triggering events', and other policy coverage issues.
In all cases we work closely with our clients to help them achieve their business objectives and are available to provide swift, practical advice in emergencies.
We are the sole product liability lawyers for Iveco, Bic, and Marubeni-Komatsu, and are the main external product liability advisers to some of the world's largest manufacturers. We also receive instructions to defend policyholders against claims on behalf of many major product liability insurers, including Great Lakes insurance, Zurich, Swiss Re, Gerling, Sompo Japan, and Mitsui Sumitomo.
In addition, we run regular client seminars, workshops, and briefings on developments in product liability law, and provide briefing notes and reviews of court decisions and new legislation of particular interest.
